TERMS & CONDITIONS ο»Ώ

Licenses & Certifications

Christine Kenyon holds commercial use permits for the National Parks Service, and/or Special Use Permits for the Bureau of Land Management, that allow her to conduct workshops in National Parks and on public lands. Christine holds current First Aid and CPR certifications and maintains the necessary insurance requirements.

Deposits

For services that require a deposit, the amount of the deposit is due upon booking a workshop. Your place is not reserved until which time your deposit is received. The balance is due in-full 90 days prior to the workshop start date. Failure to pay the balance at that time may result in the cancellation of your reservation, in order to attempt to fill your spot. All payments/deposits received are non-refundable. Any amount you have already paid automatically converts to a credit* good for two years from the first day of the cancelled workshop. (See CREDITS below)

Cancellation Policy

Cancellation requests must be made in writing - via mail or email. No refunds will be given for any reason, including delays or cancellations for reasons of inclement weather, cancelled or delayed flights, or other events/disasters, acts of God, or for any circumstance beyond Christine’s control, either before, during, or after the workshop.

Refunds

No refunds are granted for either a deposit or payment. It is highly recommended to purchase trip/travel insurance to cover any unforeseen circumstances.

  • *CREDITS: All payments/deposits received are non-refundable. Any amount you have already paid automatically converts to a credit good for two years from the first day of the cancelled workshop, minus a $250 cancellation fee. The remaining credit is good toward another workshop for the current year, or the following year. For the second year and final year, 50% of the remaining credit is available to apply toward a workshop. All workshops purchased using a credit are not eligible for any other discount. After the credit is applied to a new workshop, the remaining balance due for that workshop is paid according to the schedule stated. After two years, if you have not used your credit, it will no longer be available to use toward a workshop. Should cancelling a workshop, at any time prior to its commencement, result in Christine Kenyon being unable to fill my vacancy, any nonrefundable costs or fees (i.e., group accommodations, AirBNB, etc.) incurred by Christine Kenyon will be deducted from any existing credit good toward future bookings.

The Weather Factor

In order for night photography to be successful, one typically hopes for ideal conditions: either clear or partly cloudy skies. However, if conditions are less than ideal, Christine will look to make the most of whatever conditions the weather presents. There are no refunds or credits for inclement weather that adversely affects the trip

Workshops are typically only cancelled in the rare cases where the weather is so extreme that it presents a significant safety risk to the group, or in certain circumstances where it is determined that the conditions will gravely impact the subject matter in a region (i.e., forest fire, or extreme drought gravely impacting fall foliage on a fall color workshop). You would then be automatically enrolled in the next session, or you could opt to use your credit toward any current, or future workshop offered for a period of two years. If conditions present a risk to personal safety, there will typically be an attempt to wait out bad conditions, rather than cancel a workshop entirely.

Should a workshop get cut short due to extreme weather, or a dangerous event, there is no credit offered, unless otherwise notified.

Liability Release And Assumption Of Risk

The following language is your liability release form. The use of "I" or "my" herein refers to you, the party participating in the workshop that you are booking, and purchasing. By proceeding to book and purchase this workshop, you acknowledge that you have read, and understand the terms and conditions set forth below, and that you have agreed to all such terms.

I am aware that during any workshop or photo tour that I am participating in under the arrangements of Christine Kenyon, and her’s agents and associates, certain risks and dangers exist while traveling in the United States, within it’s national parks and wilderness areas. There is always the possibility of accident or illness occurring in remote places without access to immediate or timely medical treatment or facilities, the risk of altitude sickness, diseases, the potential for personal injury and property damage by wildlife, political instability, forces of nature and travel by air (including, but not limited to, chartered aircraft), train, automobile, bus, or other conveyance.

I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of this workshop or photo tour. In consideration of, and as part payment for the right to participate in such workshops or photo tours and/or other activities and services arranged for me by Christine Kenyon, its agents and associates.

I have and do hereby assume all of the above risks and hereby release Christine Kenyon, and will hold harmless from any and all liability, actions, causes of actions, debts, claims, and demands of every kind and nature whatsoever which I now have or which may arise of or in connection with any of my workshops or photo tours and participation in any activities arranged for me by Christine Kenyon, and her agents or associates, even though that liability may arise out of negligence or carelessness on the part of persons or entities mentioned above. Should Christine Kenyon, or anyone acting on her behalf, be required to incur attorney’s fees and costs to enforce this agreement, the enrolling trip participant(s) agree(s) to indemnify and hold her harmless for all such fees and costs. In the event a lawsuit is filed, the enrolling participant(s) agree(s) to do solely in the County of Utah in the State of Utah.

The terms hereof shall serve as a release and assumption of risk for me, my heirs, executors and administrators, and for all members of my family, including any minors accompanying me. Christine Kenyon, her agents and associates, act only as agents for the passenger in regard to travel including, but not limited to, sightseeing, meals, lodging, transportation, and all other services whether by railroad, motorcar, motor coach, boat, or airplane and they assume no liability for injury, damage, loss, accident, delay, or irregularity which may be occasioned either by reason of defect in any vehicle or for any reason whatsoever, or through the acts or default of any company or person engaged in conveying the passenger or in carrying out the arrangements of the trip.

Christine can accept no responsibility for losses or additional expenses due to delay or changes in air or other services, sickness, weather, strike, war, quarantine, or other causes. All such losses or expenses will have to be borne by the passenger, as trip fees provide for arrangements only for the time and locations stated.

The right is reserved to substitute lodging of similar category for those indicated and to make any changes in the itinerary or transport where deemed necessary or caused by changes in air schedules or equipment substitution. The right is reserved to cancel any trip prior to departure, in which case full refund, or full credit, of the paid trip funds will be given, but Christine Kenyon is not responsible for any other trip preparation expenses such as penalized or non-refundable air tickets, visa fees, accommodation booking fees, and medical related expenses. Baggage is at the owner’s risk entirely.

The right is reserved to decline to accept or to retain any participant as a member of any trip. This includes, but is not limited to, behavior not conducive to the cohesiveness of the group.

Statement of Agreement

I have read and agreed to the terms and provisions stated on the event description for the workshop or photo tour for which I have enrolled, especially noting the policy on cancellations, refunds, and limitations on responsibility as specified above. I am aware that the detailed itineraries are subject to change due to changes in weather, natural events, or other logistical arrangements deemed necessary.

I, the workshop participant, acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against Christine Kenyon, on the basis of any claim from which I have released her. I have had sufficient time to read this entire document, and have read and understood it, and agree that by making this deposit I am bound by its terms.
